Abstract

La topografía juega un papel importante en nuestro auge de desarrollo en obras civiles, titulación de tierras y para el cuidado de nuestro medio ambiente. Nuestros topógrafos profesionales aportan diariamente su saber y experiencia al desarrollo del país encargándose de realizar los levantamientos topográficos, geodésicos, catastrales, fotogramétricos, avalúos, documentos público y peritajes, que se han desarrollado en las instituciones del sector público y privado para proyectos pequeños y mega obras. La exigencia de todo profesional, un experto en un arte u oficio, como el topógrafo en su trabajo implica actuar con diligencia, con una conducta adecuada y eficaz para el ejercicio de su profesión, trabajar con desempeño y claridad de manera que no perjudique a sus consumidores que solicite sus servicios o al infringir las leyes en conformidad a su ética profesional. En esta investigación sobre LA RESPONSABILIDAD CIVIL DEL TOPÓGRAFO EN LA LEGISLACIÓN PANAMEÑA Y DERECHO COMPARADO, se pretende analizar e identificar si el topógrafo puede recaer en responsabilidad civil, determinar en qué casos o supuestos ocasionan daño a su cargo, también como nuestra legislación positiva panameña en civil puede regular las causas y afectaciones al momento de ejecutar su actividad o experticia, haciendo comparación con leyes internacionales que regulan esta clase de situaciones no tratadas en Panamá. Por otra parte, en este trabajo de investigación mencionaremos sus funciones, reglas u obligaciones, las normas e instituciones que regulan a este profesional idóneo en la República de Panamá y a nivel internacional, con el objetivo de determinar el alcance de su obligaciones y de responsabilidad civil frente a sus clientes, así dar como resultado la solución y reforma en aquella incertidumbre legal que hoy en día en Panamá no son reguladas, consecuencias causadas a futuro y que son derivadas de su experticia, con la finalidad de motivar un enfoque de interés e importancia legal a este rol que tiene el topógrafo como profesional en nuestra legislación. Topography plays a crucial role in the development of civil works, land registration, and environmental conservation. Our professional surveyors contribute their knowledge and expertise daily to the country's growth by performing topographic, geodetic, cadastral, photogrammetric surveys, appraisals, public documents, and expert evaluations, which are essential for both small projects and large-scale constructions in both public and private sectors. The expectations placed upon professionals in their respective fields, such as surveyors, require them to act diligently and maintain conduct that is ethically sound and effective in their practice, ensuring that they do not harm their clients or violate legal statutes. This research focuses on the civil responsibility of surveyors under Panamanian legislation and comparative law. It aims to analyze and identify situations where surveyors may incur civil liability, recognizing the circumstances that may lead to damages under their purview. Additionally, it examines how Panamanian civil law regulates causes and repercussions arising from their professional activities, while drawing comparisons with international laws addressing similar issues not yet covered in Panama. Furthermore, this study outlines the functions, regulations, and obligations of surveyors, highlighting the norms and institutions that oversee these professionals in Panama and internationally. The objective is to clarify the extent of their obligations and civil responsibility towards clients and to propose solutions and reforms for the current legal ambiguities that exist in Panama. This research seeks to underscore the legal significance of the surveyor's role in our legislation, advocating for recognition and interest in their professional contributions.
